Documents show EPA let Bayer choose dicamba regulation options

Newly released EPA internal records show the agency asked Bayer which mitigation options it preferred for the drift‑prone herbicide dicamba, then incorporated Bayer’s selections into a proposed federal rule. The documents show EPA presented a range of options to limit dicamba volatility and runoff, asked Bayer “Which mitigation option to go forward with?” and received responses that favored less protective measures; Bayer picked the least protective option for one regulation and the middle option for another, and secured one other requested change. Dicamba is linked in the records to liver cancer and Non‑Hodgkin lymphoma and is highly prone to drift, which courts have twice cited when ordering it off the market even as the EPA later reapproved it. Environmental groups Center for Biological Diversity and Center for Food Safety brought the litigation that produced the documents; Nathan Donley of the Center for Biological Diversity called the exchange a crossing of a line. The records arrive amid criticism that the EPA’s toxics office is led by former chemical industry officials, including Kyle Kunkler, now a deputy assistant administrator who oversees the pesticides program. An EPA spokesperson said the agency notifies registrants, works with them to identify solutions, and that registrants do not dictate terms.
