Meta sued for using AI to tag employees on leave

Twenty-six current and former Meta employees filed a federal lawsuit in the Northern District of California alleging the company used internal AI systems to identify workers for a spring workforce reduction of about 8,000 people. The 71-page complaint says a "constellation of internal artificial intelligence systems," including AI performance ratings plus keystroke and activity monitoring, scored, ranked and selected employees for layoffs rather than managerial judgment. Plaintiffs say those systems flagged employees after they took protected family or medical leave or sought disability accommodations, and that metrics used by the AI did not exist or declined while employees were on leave. The suit describes specific cases: a scientist on approved pre-birth pregnancy leave was notified of layoff two days before giving birth, an engineer received a lowered rating after time off for an injury, and a manager was terminated 16 days into medical leave. Plaintiffs seek a preliminary injunction to block Meta from finalizing layoffs and ask for relief including reinstatement, back pay, lost equity, benefits and other damages. Meta disputed the claims, saying the allegations lack merit and that workforce decisions were made by people, not AI. The complaint also notes growing regulatory attention, pointing out recent state laws in California, Colorado and Illinois addressing automated decision systems and worker protections.
