Judge orders Elon Musk to give deposition in election lottery case

Magistrate Judge Susan Hightower in Austin ordered Elon Musk to sit for a sworn deposition in a fraud lawsuit over a $1 million voter registration giveaway run by his political committee America PAC. Two Arizona women who signed petition forms say America PAC misled them into providing personal information by promising a chance to win the daily $1 million prize and contend the winners were not chosen at random. Hightower’s order requires on-the-record questioning by opposing lawyers that will let plaintiffs probe how winners were selected, who funded the giveaways, and what representations were made to voters. A federal judge in Texas has already ruled that a fraud claim will proceed while a related contract claim may be dismissed, narrowing the case around the alleged deceptive scheme. Plaintiffs characterize the giveaway as vote buying targeted at swing-state voters during the 2024 cycle, and the deposition may produce documents or testimony central to class certification and pretrial rulings. Musk must answer under oath and his testimony can be used at trial or to expand discovery.
