Congress launches probe into talks to suspend habeas corpus

House Democrats launched a formal probe and sent letters to the White House demanding memoranda and records showing whether the Trump White House considered suspending the writ of habeas corpus and invoking the Insurrection Act. The letters seek internal memoranda, emails, briefing materials and other documents and instruct the White House to preserve those records. Documents and accounts show senior White House advisers discussed suspending habeas for immigration cases and using the Insurrection Act to bypass courts and deploy federal forces. If confirmed, suspending habeas would strip detainees of their ability to challenge unlawful detention and represent a major expansion of presidential power with broad consequences for immigrants, protesters and judicial oversight.
