The Vice President of the United States wanted to use the Insurrection Act to quash protests and Stephen Miller wanted to suspend habeas corpus rights. These are basic constitutional freedoms. Stephen Miller is trying to suspend habeas corpus, which allows people to challenge the basis of their detention, in some immigration cases. Miller's attempt to revoke this fundamental aspect of due process is an egregious violation of our Constitution, and we're fighting back.

I wonder if this is in part a reaction to the recent story about White House efforts to suspend habeas corpus and invoke the insurrection act.

Among all these inflection points, the ultimately aborted push to suspend habeas corpus last spring stands out to me as particularly dangerous and significant because at that moment, the Trump regime was overall in a much stronger position than at any point since.

A conservative White House lawyer alarmed by plans to suspend habeas corpus for undocumented immigrants penned a memo explaining that the Constitution forbids the president from doing so.
