The Justice Department asked a federal judge Monday to dismiss an NAACP lawsuit over xAI’s polluting gas turbines, arguing the turbines and xAI’s Grok chatbot are 'vital' to national security. DOJ lawyers told the court the turbines power the data center running Grok and that Grok supports military operations under a Pentagon contract. The NAACP suit challenges pollution and local health impacts from the turbines, and DOJ’s filing seeks to block that environmental claim by invoking national security. If the court accepts the government’s argument, private tech infrastructure could gain broad protection from environmental lawsuits, raising new questions about accountability and community health.

The fact that the US government is using xAI at all is terrifying. It is unusably bad. There is an argument to be made whether the Defense Department should be using AI at all. But if it is it should use a tool that actually works.
