Judge orders White House to restore press credentials

A federal judge granted CNN, Politico and MS NOW a temporary restraining order requiring the White House to immediately restore those outlets’ hard-pass press credentials in Cable News Networks, Inc. v. Trump. Judge Timothy Kelly wrote that the defendants, excluding President Donald Trump, must “immediately return, reinstate, and restore” the badges that were revoked on Sept. 18. The order will remain in effect for 14 days while the lawsuit, which accuses the president of violating the First Amendment, proceeds. The restoration requirement takes effect immediately and the case will continue through the federal courts during the TRO period.

The plaintiffs state that despite the order, journalists from CNN, MS NOW, and POLITICO attempted to enter the White House that morning and were turned away. The filing alleges that Secret Service agents also confiscated hard passes from journalists whose passes had not previously been taken. It specifically says plaintiff Betsy Klein, whose hard pass had been confiscated on September 19, requested its return but was denied and refused access to the White House complex.

The filing emphasizes urgency because CNN is scheduled to serve as the television pool for President Xi Jinping’s visit to the White House that evening. It concludes by stating that plaintiffs’ counsel contacted defense counsel that morning and asked to call the court together, but defense counsel had not responded. Reporters stood at the White House gate this morning holding a federal judge’s order that said let them in, & were turned anyway. No explanation. No comment. Just a president ignoring a court like it’s beneath him. This is an unprecedented, fascist assault on free speech. Free the press!

Early this morning the Court issued a Temporary Restraining Order directing "that Defendants (except for President Trump) and their agents, representatives, and all persons or entities acting in concert with them shall immediately return, reinstate, and restore the White House "hard pass' press credentials held by employees of CNN, MS NOW, and POLITICO that were revoked on or about September 18, 2026." Dkt. 24 (the "Order"). This morning journalists from each of CNN, MS NOW, and POLITICO attempted to enter the White House and were turned away, and Secret Service agents confiscated the hard pass of journalists whose hard passes
had not previously been confiscated. And when Plaintiff Betsy Klein, whose hard pass was confiscated on Saturday, September 19, requested to have her hard pass returned, her request was denied and she was refused access to the White House complex. And time is of the essence CNN is scheduled to be the television pool this evening for President Xi Jinping's visit to the White House.
Counsel for Plaintiffs reached out to counsel for Defendants this morning and requested to
call the Court together. Counsel for Defendants has not responded.
