Justice Brett Kavanaugh, acting as circuit justice for the Eighth Circuit, denied Missouri officials’ emergency request to let the state use a new congressional map that would have benefited Republicans, deferring to a Missouri Supreme Court ruling that said the map cannot be used unless voters approve it. The Missouri secretary of state sought the high-court intervention with backing from the Republican National Committee, but Kavanaugh declined to override the state court’s order. Minutes after Kavanaugh’s decision, U.S. District Judge Stephen Clark issued a conflicting injunction directing Missouri to use the new GOP-drawn map for November ballots, creating two opposing federal and state orders. Opponents of the map, including intervenors Richard von Glahn and the group People Not Politicians, have moved to block the new map and quickly appealed the federal ruling. Legal observers and parties told reporters they expect swift appeals to the Eighth Circuit and another likely trip back to the Supreme Court, leaving which map will govern the November congressional elections uncertain. The immediate consequence is conflicting court orders and an expedited appellate scramble to resolve whether Missouri will use the state Supreme Court’s 2022-era map or the GOP-drawn map for the midterms.
