Roger Marshall Sued 700 Patients; 81 Were Arrested, NYT Reports

The New York Times found that Senator Roger Marshall, a Kansas Republican and former obstetrician-gynecologist, sued roughly 700 former patients over unpaid medical bills and routinely charged an 18 percent annual interest rate. The Times reports that 81 people were arrested after court actions tied to those suits, and Marshall’s lawyers garnished paychecks and bank accounts in some cases. The paper interviewed eight people Marshall sued between 2003 and 2015; examples include Kellie Clutts, sued in 2015 over a $129 postpartum visit, Meischa Zimmerman, who said she was arrested three times over a C-section bill, and Joe Vasquez, who spent two days in jail during Easter weekend 2007 before his family borrowed bond money. Marshall’s spokeswoman said judges issue warrants when people repeatedly miss court dates, while The Times notes Marshall’s lawyers asked judges for arrest warrants. Marshall is the incumbent senator and is seeking re-election this fall.

What a fucking fucker. When my friend, a Viet Nam vet, died of liver cancer, I took all the bills and called accounting departments to tell them there was no money to pay them. 80% forgave the debt. It was the fancy doctor conglomerates that were assholes about it.

Reminder: Doctors are second only to nurses in the extent to which Americans trust them. Patients aren't looking to screw their health care providers. Of course, everyone needs to make ends meet, but patients being unable to pay medical bills is a tragedy that demands policy change, not lawsuits.

Setting aside the general grotesqueness of the story, and further setting aside the potential political ramifications, a substantive (naive?) question of practice: Is this common? For practitioners? Suing patients individually over debt? I’m just stunned by every word & not sure if I should be?
