EEOC moves to end 60-year employer demographic reporting

The Equal Employment Opportunity Commission’s Republican majority voted 2-1 to rescind the 60-year-old EEO-1 demographic reporting requirement, submitting the proposal to a 30-day public comment period before final approval. EEOC Chair Andrea Lucas argued the annual reports risk promoting racial stereotyping and may encourage employers to engage in discrimination. Since 1966 employers with at least 100 workers, and federal contractors with at least 50, have filed the EEO-1, which breaks workforce counts by 10 job categories, gender, and race and ethnicity; the data typically covers more than 50 million employees and about 73,000 employers. The EEOC receives more than 88,000 worker complaints annually and has historically used EEO-1 data to guide enforcement priorities and target investigations. Commissioner Kalpana Kotagal, the commission’s lone Democrat, voted against the proposal and warned it would weaken the agency’s ability to protect workers. Former Democratic commissioners and civil rights organizations criticized the move, saying ending the collection would deprive the agency and the public of a key tool for spotting discrimination trends; the EEOC under the Biden administration had published an interactive tool using historical EEO-1 data, with the most recent public data from 2023 and undisclosed 2024 data. If finalized, the change would halt collection that would have begun for 2025 and reduce a centralized source of workforce demographic information used in discrimination enforcement and public transparency.
