Jack Smith, the former special counsel who brought two federal indictments against President Donald Trump, gave his first televised interview since resigning to MS NOW host Nicolle Wallace. Smith said the rule of law is under an attack “different in kind and scope to anything I’ve seen in my lifetime” and defended his work as grounded in facts and law, not politics. He repeated that he pursued the election-interference case because the evidence showed Trump was culpable in the Jan. 6, 2021, assault on the Capitol after urging supporters to march there. Smith confirmed he also indicted Trump over classified documents retained at Mar-a-Lago but declined to discuss that matter because the report is under seal and a Florida judge’s court order limits comment. Appointed by Attorney General Merrick Garland in 2022, Smith said both criminal cases were dismissed after Trump won a second term because of DOJ policy barring prosecution of a sitting president. Smith criticized the Justice Department’s current effectiveness, warned he is “very concerned” about the integrity of the next election, urged state attorneys general to uphold the rule of law, and said he will “not be intimidated.”
