ABC argues FCC violated First Amendment in dispute over The View

ABC sued the Federal Communications Commission, arguing the agency's inquiry into whether The View still qualifies for a 2002 broadcast news exemption violates the First Amendment. ABC said the exemption has gone unchallenged for 24 years and that the probe escalated after the FCC unusually opened early license reviews of all eight ABC owned local stations. The Houston station's petition was signed by one of the country's most experienced Supreme Court litigators, and ABC says a ruling could limit the FCC's ability to use regulatory processes to scrutinize or restrict broadcasters' editorial viewpoints.
