Federal judges appoint special counsel to probe DOJ lawyer Kevin Bolan

U.S. District judges in Rhode Island appointed a special counsel to investigate Justice Department lawyer Kevin Bolan. The judges say Bolan withheld from U.S. District Judge DuBose that a detained noncitizen had an outstanding murder warrant and misled the court during immigration proceedings. The special counsel will decide whether to pursue disciplinary or criminal charges, a probe that could prompt accountability for prosecutors and affect transparency in federal immigration litigation.

They tricked the judge into releasing a murder suspect to score a few cheap political points. They deliberately chose to make the community less safe so they could play a game of gotcha. WTF?

This is great, but I wish judges would refer DOJ attorneys to disciplinary commissions for unethical misconduct that impacts defendants, instead of just misconduct that impacts judges.

Perhaps there should be more aggressive enforcement of the presumption of regularity by the Article III branch. Criming is criming even if you wear a coat and tie and went to a prestigious or shitty law school. The courts have been too deferential.

Good work on this! I wanted to know more and was startled to learn the targeted judge is Black. Because, esp considering events in the country and courts rn, choosing to smear a *Black* federal judge is relevant. And, she is openly LGBTQ. Also relevant. IMO NYT should add these facts to coverage.

Incredible ethical violation alleged. Sounds like an AUSA could be disbarred and DHS Officials referred for Impeachment. Also, I did not realize that Federal Judges could appoint Special Counsel.
