New York enacts nation's first statewide data-center moratorium

New York Gov. Kathy Hochul signed an executive order on Tuesday imposing the nation’s first statewide moratorium on hyperscale data centers, pausing state permitting for new large facilities for up to one year. The order targets the largest, energy- and water-intensive data centers that power artificial intelligence and directs state regulators to develop standards addressing environmental impacts, energy demand and water usage. Hochul said, "Before it goes any further, I need safeguards in place to protect New Yorkers," and framed the pause as a response to rising utility bills, depleted natural resources and uncertainty for residents. NBC News and other outlets reported the moratorium will block construction of new large data centers while the state creates rules to protect the environment and the energy grid. The executive order differs from legislation the state legislature passed earlier this year, and some advocates and commentators said the order is weaker than that bill. The pause will last up to one year while regulators write the new standards; the move makes New York the first state to impose such a statewide freeze.

It's an up to year long moratorium in order for rules to be created to protect the environment and energy grid. This is the beginning, and residents of NY must push for actual, meaningful protections.

Well done, Hochul! Her Republican opponent, Bruce Blakeman, opposes a moratorium. I don’t see that being a popular position anywhere in the state (I could be wrong)
